Libertarian Party of Clark County

Adopted in Convention, February 2009

Article I: Name

The name of this organization shall be the Libertarian Party of Clark County, hereinafter referred to as "LPCC".

Article II: Principles

We hold that all individuals have the right to exercise sole dominion over their own lives, and have the right to live in whatever manner they choose, so long as they do not forcibly interfere with the equal right of others to live in whatever manner they choose.

Article III: Purposes

The purpose of this organization is to advance our principles through the political process.

Article IV: Membership

A member of the LPCC is a person who meets all of the requirements in sections 1 through 3 of this article.

1. For at least 60 days has been a resident of Clark County, Nevada.

2. For at least 60 days has been registered to vote in Clark County, Nevada with Libertarian Party affiliation, or otherwise provides evidence of being at least 18 years old and legally ineligible to register to vote.

3. Can be verified as a Sustaining Member of the Libertarian Party of the United States (hereinafter LPUSA), and currently pays LPCC Membership Dues.

4. Dues

 a. Membership dues shall be twenty-five dollars a year.

 b. A member whose dues is not otherwise considered current, shall be considered current if he or she is and has been a member of the Nevada Libertarian Party’s 1776 Brigade for at least the past three months.

5. Sustaining Member

 a. “Sustaining Member” currently means someone who has donated $25 to the LPUSA in the past year and has certified in writing that they oppose the initiation of force to achieve political or social goals.

 b. If the LPUSA redefines Sustaining Member to a more restrictive standard, the new more restrictive standard will be the one used in these bylaws.

 c. If the LPUSA redefines Sustaining Member to a less restrictive standard, the standard defined in subsection "a" of this section will be operative as to these bylaws.

 d. Each prong of the definition of Sustaining Member will be considered separately to determine if it is more or less restrictive.

Article V: Officers

1. The officers of the LPCC shall be a Chair, Vice Chair, Recording Secretary, Corresponding Secretary, and Treasurer.

2. The officers shall be elected by a majority vote of the LPCC Convention, in odd-numbered years, by the manner prescribed in Article VI, Sections 5 and 6. The officers' terms of office shall begin at the close of the convention at which they are elected.

3. The officers must be members of the LPCC. No member shall hold more than one office at a time within the LPCC. The officers shall perform the duties prescribed by these bylaws and by the parliamentary authority adopted by the LPCC. These duties shall include the following:

 a. The Chair shall preside at all LPCC meetings and Conventions. The Chair shall be an ex-officio non-voting member of all standing committees. The Chair may, by and with the consent of the Executive Committee, appoint Positions or Committees for such functions as Outreach, Campaigns Fundraising, Convention, or others deemed necessary to assist in the performance of the Chair's duties. In the event of a vacancy in an officer position, the Chair shall, with the consent of the Executive Committee, fill the vacancy by "Pro Tem" appointment, until the next annual County Convention.

 b. The Vice Chair shall assist the Chair in the performance of the Chair's duties. At meetings of the Executive Committee, the Vice Chair shall preside in the absence of the Chair.

 c. The Recording Secretary shall record and maintain records of Executive Committee meetings and party conventions, and all non-financial records of the LPCC including but not limited to these bylaws and all committee reports.

 d. The Corresponding Secretary shall send out membership notices of meetings and conventions. The Secretary shall deliver the list of nominees for political office to the convention of the Libertarian Party of Nevada (LPN), and submit the certificate of existence to the LPN (in compliance with Article VII, sections D and E of the LPN bylaws) within two weeks after each convention of the LPCC.

 e. The Treasurer shall maintain the LPCC's bank accounts, deposit all revenues, and pay all bills. A formal Treasurer's Reports shall be presented annually, at the County Convention. The Treasurer shall maintain the LPCC's financial records in accordance with the law and generally accepted accounting principles.

4. The Executive Committee shall have general supervision of the affairs of the LPCC between its conventions, fix the hour and place of meetings and conventions, and shall perform other duties as are specified in these bylaws. The Executive Committee shall be subject to these bylaws, and none of its acts shall conflict with action taken by the LPCC in a convention.

Article VI: Annual Conventions

1. The LPCC shall hold a convention sometime during January through May in even-numbered years for the purpose of choosing candidates for public office and whatever business shall be deemed necessary and proper, including but not limited to amending these bylaws and filling vacancies in the Executive Committee.

2. The LPCC shall hold a convention sometime during January through May in odd-numbered years for the purpose of the choosing of LPCC officers, amending these bylaws, and whatever business may be deemed necessary and proper.

3. All LPCC members are qualified to be delegates to the County Convention.

4. All LPCC members shall be deemed to be adequately notified of the date and location of the County Convention as well as any proposed amendments to the bylaws if the same have been prominently placed on the website of the LPCC at least 45 calendar days prior to the convention.

5. All elections for officers and candidates shall be by a majority vote by secret ballot.

6. Votes cast for "none of the above" (NOTA) shall be considered valid. Should NOTA receive a majority of the vote in the balloting for any office or candidacy, the names of all nominees shall be kept on the ballot but the nominations for that office shall be re-opened for additional nominees and another ballot taken.

7. In an officer election, successive votes shall be taken until the position is filled by majority vote.

8. In a nomination for public office, should NOTA receive a majority on two successive ballots, then no candidate shall be nominated for that office.

Article VII: Candidates for Partisan Public Office

1. The LPCC may nominate candidates for public office by ballot of the annual LPCC Convention during an even numbered year, by the manner prescribed in Article VI, Sections 5 and 6.

2. No more than one candidate may be elected to be the nominee of the Libertarian Party for any non-partisan office.

3. The Corresponding Secretary of the LPCC or the Corresponding Secretary's representative shall deliver a list of the nominated candidates, including NOTA, to the convention of the Libertarian Party of Nevada.

Article VIII: Executive Committee Meetings

1. Meetings of the LPCC Executive Committee shall be held at least quarterly. Meetings shall be held in Clark County, Nevada at such time and place as the Executive Committee shall determine by vote.

2. Executive Committee Meetings shall be open to all LPCC members.

3. The Executive Committee shall consist of all Officers and all Voting Members. Officers and Voting Members shall each have one vote.

4. Voting Members

 a. A person is a Voting Member of the Executive Committee if he or she:

  · is a Member of the LPCC, and
  · has successfully petitioned the Executive Committee.

 b. A petition to become a Voting Member of the Executive Committee can only be made by a LPCC Member who has attended the past two consecutive Executive Committee meetings.

 c. To be successful, a petition to be a Voting Member of the Executive Committee must be approved by at least two-thirds of the Executive Committee.

 d. At the end of their term of office, former officers become Voting Members of the Executive Committee, provided the former officer was not impeached.

5. Voting membership can only be terminated by Abandonment or Official Revocation.

 a. Abandonment

  · A Voting Member who is absent from two consecutive meetings of the Executive Committee shall have his voting privileges deemed to have been terminated by Abandonment. Voting Privileges can be reacquired by successfully petitioning the Executive Committee according to the procedures outlined in section 4 of this article.

  b. Official Revocation

  · A Voting Membership shall be deemed to have been Officially Revoked if all five of the Officers of the Executive Committee shall so vote at a meeting of the Executive Committee.

  · Any Officer of the Executive Committee shall be able to motion for the Official Revocation of any Voting Member at any meeting. At the following meeting, the Voting Member whose privileges are up for revocation shall have the opportunity to make his case before the officers of the Executive Committee. After the member in question has had a reasonable time to make his case as determined by a majority of the Executive Committee and before the meeting is adjourned, the officers shall vote. The vote shall be by recorded vote.

  · The member shall be immediately reinstated if the Executive Committee votes by a two thirds majority to reinstate the member. The meeting may not be adjourned before the Executive Committee has completed such a vote.

  · If the member is not immediately reinstated, voting privileges can be reacquired by successfully petitioning the Executive Committee according to the procedures outlined in section 4 of this article.

6. A quorum shall consist of:

 a. a majority of officers, or
 b. at least two officers and a majority of the Executive Committee.

7. Notice of establishment or of changes in the meeting time and place shall, at minimum, be given to the current members of the national Libertarian Party residing in Clark County. Notice shall be considered sufficient if it is prominently placed on the website of the LPCC at least one week in advance of the meeting.

8. A system of email voting shall be established by the Executive Committee. This system shall be constructed so as to allow for voting on issues between monthly Executive Committee meetings. To pass, a measure must be approved by a majority of the members of the Executive Committee.

Article IX: Amendments

1. These bylaws may be amended by two-thirds vote by delegates at the county convention.

2. To be considered in convention, all bylaws proposals and amendments thereto must be presented in writing to the Recording Secretary, before or during the county convention.

Article X: Parliamentary Authority

The rules contained in the current edition of Robert's Rules of Order Newly Revised shall govern the LPCC in all cases to which they apply, and in which they are not inconsistent with these bylaws, any special rules of order the LPCC may adopt, and any statutes applicable to the LPCC.
